SHORT TERM RENTAL AGREEMENT

1. The Parties: This agreement made at the time the reservation is made and the payment has been accepted, is between the card holder (hereinafter referred to as “Tenant”), and landlord (Kyle Crow) of 410 W. Rezanof Dr., Kodiak, Alaska 99615, (hereinafter referred to as “Landlord”.)
 

2. The Property:  Property Location: 410 W. Rezanof Drive, Kodiak, AK 99615
 

3. Period and Guests:  Total people in renting party shall not exceed five (5.) The rental period begins at (local time) on the first day of the reservation and ends at on the last day of the reservation.
 

4. Rental Amount:  The total rental amount for the period will be equal to $315.00 per night, total, for the first two guests. An additional fee of $200 per night, total, will be charged for additional guests. So, for the first two guests the total rental amount will equal a total of $315 per night. If more than two quests (maximum 5) will be staying, the total cost for each night of lodging will be $515. Please contact the Landlords authorized agent, Brook Sergeant, at (907)202-4824 () to discuss options for possible discounts or to arrange for additional services or special needs.
 

5. Fees, Taxes, and Deposit: All fees, taxes, and deposit, are included in the rental amount noted above.
 

6. Termination:  The Landlord has the right to inspect the premises and complete necessary repairs with prior notice as stated with the applicable laws. Should the Tenant violate any of the terms of this agreement, the rental period shall be terminated immediately in accordance with applicable law. The Tenants waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Tenants shall vacate the premises at the expiration time and date of this agreement.
 

7. Maintenance and Repairs: The Tenants shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The tenants agree that the Landlord shall deduct costs of said services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings. 
 

8. House Rules: Tenant agrees to abide by the House Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else the tenant permits on the property to abide by such rules at all times while at the property.
 

9. Trash: The Tenants shall dispose of all waste material generated during the rental period in the designated garbage and recycling area. A bear proof roll cart is provided off the street in front of the house for the Tenants use.
 

10. Subletting: The Tenant shall not have the right to sublet the property.
 

11. Quiet Enjoyment:  The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises.
 

12. Essentials: Landlord shall provide the Tenant with towels, linens, cups, knives, forks, spoons and dishes, stove, refrigerator-freezer, washer & dryer, and furniture. It is the responsibility to the Tenant to clean the forgoing during the tenancy.
 

13. Landlord’s Liability: The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Guests if such coverage is desired.
 

14. Rental Deposit Amount is fully refundable up to two weeks prior to the beginning of the rental period. After said period prior to the rental start date the Landlord shall have the right to retain the initial Rental payment at the Landlord's discretion.
 

15. Attorney’s Fees: Tenants agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Landlord enforcing this agreement.
 

16. Use of Property: Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household nor will it be used for commercial purposes.
 

17. Shortened Stays and Conditions: There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.
 

18. Firearms and Hazardous Materials: Legal firearms are allowed on the premises. Discharge of firearms is prohibited within the City Limits of Kodiak. Tenant agrees that Fireworks and other hazardous materials shall not be brought onto or used in or around the property.
 

19. Illegal Use:  Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits.
 

20. Possessions:  Valuable items left behind by tenant will be held for the tenant and every reasonable effort will be made to contact the tenant for return. If items are not claimed for longer than 15 days they shall become the property of the Landlord. The Landlord shall not be held liable for condition of said items.
 

21. Internet:  Internet High speed wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service. The Tenant agrees to use the internet in a legal and lawful manner.
 

22. Other Agreements:  There shall be no other agreements or conditions in addition to those stated in this agreement and the following rules, unless made by the Tenant and Landlord in a separate record (e.g. by email correspondence and or, a signed and dated letter. By completing the reservation and making a credit card payment, the Tenant agrees to the above conditions and hereby swears that the information provided is accurate and true:

Exhibit A House Rules

1. No pets
 

2. No smoking (Marijuana or tobacco cigarettes, cigars, electronic cigarettes or any similar product whose use generates smoke or vapors), parties, or events
 

3. Check-in is any time after 2PM and check out is by 12PM
 

4. Self-check-in is with keypad code
 

5. Guest must be 21 years of age or older or unless accompanied by an adult
 

6. Alaskans don’t wear their shoes and boots in the house. We hope that you will adopt, appreciate and respect the wisdom of this custom during your visit.
 

7. Use dark towels to remove any makeup ($25 charge if white towels used and are unable to come clean)
 

8. Please be respectful of the neighbors and reduce noise volume between 10PM & 8AM
